Not necessarily. The police case will start at the investigation stage, which will include the securing and preserving of any evidence. This is done by questioning a suspect and taking any necessary witness statements both for and against the accused. When the police investigation stage is complete, the sergeant or crown prosecution service will have the final decision on whether or not there is sufficient evidence to prosecute to court.
